Appeal for failure to decide on time

When you have submitted an application to the IND, for example for family reunification or an asylum permit, the IND must make a decision within a statutory period. This statutory period varies depending on the procedure and type of application.

In practice, it regularly happens that the IND does not decide on time and exceeds the statutory period. When the IND is late in making a decision, we can request the court to compel the IND to issue a decision on your behalf. This legal action is called an “appeal for failure to decide on time.”

In such cases, the court usually orders the IND to decide within a period set by the court. If the IND still fails to make a decision, they must pay you a sum of money. This is a financial penalty that the IND owes you for each day a decision is not made. This penalty often amounts to €100 per day, with a maximum of €7,500 for the first delay.

At migrantrecht.nl, we initiate court proceedings free of charge when the IND is late in deciding. We help you compel the IND to make a decision.
